T.C. Memo. 2015-43: Balsam Mountain Investments, LLC

United States Tax Court held that a conservation easement granted by Balsam Mountain Investment,LLC, is not a "qualified real property interest" because the grant allowed the land subject to the easement restrictions to change over time. Land--up to 5% of the orginal 22 acres--could be removed from the restricted area if an offsetting amount of land contiguous to the easement boundary was added to the restricted area.
